Resumo: Este artigo apresenta os principais debates acerca da proteção de variedades vegetais, em especial os pontos aplicados à legislação brasileira representada pela Lei de Proteção de Cultivares (LPC) nº 9.456, promulgada em abril de 1997, a qual, nos últimos anos, vem sendo objeto de projetos de lei para alterar seu conteúdo. Ao fazer um resgate histórico da construção de legislações de variedades vegetais, o objetivo do artigo é apresentar os pontos polêmicos envolvidos com a proteção de cultivares com base nas normativas internacionais, representadas pelas Atas da União para a Proteção das Obtenções Vegetais (Union pour la Protection des Obtentions Végétales - sigla Upov em francês) e com relação ao Acordo sobre os Aspectos de Direito de Propriedade Intelectual Relacionados ao Comércio (Trade-Related Aspects of International Property Rights - sigla Trips em inglês). Para tanto, serão apresentadas as principais discussões acerca da temática e os possíveis caminhos que os países poderão tomar no que diz respeito às políticas agrícolas de melhoramento de sementes. Com base em visões favoráveis e contrárias ao uso da propriedade intelectual em processos inovativos, os principais pontos de atenção da LPC são apresentados. A conclusão do trabalho é que os caminhos para a alteração da LPC são muitos, e os principais pontos de atenção demandam análise minuciosa. Abstract: This article presents the main debates about protection of plant varieties, in particular the issues applied to the Brazilian legislation represented by the plant variety protection law (LPC) No. 9.456, enacted on April 1997, which, in recent years, has been the subject of bills to change its content. It presents the historical path that results in the construction of plant variety legislation, describes the controversial points for plant variety protection involved with the international guidelines, represented by the International Union for the Protection of New Varieties of Plants (Union pour la Protection des Obtentions Végétales, - acronym Upov in French) and concerning the Trade-Related Aspects of Intellectual Property Rights Agreement. Therefore, the article will describe the main discussions concerning plant variety laws, and the possibilities a country can choose while developing or adapting agricultural policies for seed breeding. Favorable and opposing views on the use of intellectual property in innovative processes guide this discussion and help to present the main LPC points of attention for Brazilian legislation. The conclusion of this work is that the paths for alteration of the LPC are many, and the main points of attention demand detailed analysis. Sustainable production systems, such as the no-tillage system (NTS), have a tendency to increase organic carbon in the soil. However, in Brazilian cotton production, the conventional tillage system (CTS) is predominant, and long-term studies on cotton crop under the NTS are scarce. The present study aimed to evaluate the effect of soil management and crop rotation systems on the cotton fiber yield as well as on the carbon and nitrogen accumulation in the soil. This study was conducted in the Brazilian savanna over 9 years and consisted of the following four treatments with different soil management systems: the NTS and CTS with the succession or rotation of crops (cotton, soybean, maize, and Urochloa ruziziensis). The NTS increased the carbon content by 55% in the top 5 cm after 9 years and increased the carbon stock by approximately 20% at a depth of up to 40 cm. Crop rotation with soybean, maize, and cotton was insufficient to increase the carbon stock in the soil under the CTS. In addition to increasing the fiber yield, the cotton crop in a NTS rotated with soybean + U. ruziziensis and with maize + U. ruziziensis increases the carbon stock and nitrogen content in soil. |
